{"id":110928,"date":"2019-07-15T09:44:41","date_gmt":"2019-07-15T09:44:41","guid":{"rendered":"http:\/\/mlnv.org\/news\/?p=110928"},"modified":"2019-07-15T09:45:07","modified_gmt":"2019-07-15T09:45:07","slug":"recupero-crediti-la-prepotenza-non-paga","status":"publish","type":"post","link":"https:\/\/mlnv.org\/news\/recupero-crediti-la-prepotenza-non-paga\/","title":{"rendered":"RECUPERO CREDITI: LA PREPOTENZA NON PAGA"},"content":{"rendered":"<header class=\"entry-header\">Arrivano le prime <strong>sanzioni<\/strong>\u00a0per le\u00a0<strong>societ\u00e0 di recupero crediti<\/strong>\u00a0che, pur di incassare, pongono in essere\u00a0<strong>tecniche di pressione che vanno oltre il legittimamente accettabile<\/strong>.<\/header>\n<div class=\"entry-content\">A farne le spese \u00e8 questa volta la societ\u00e0 di recupero crediti<strong>\u00a0Fire S.p.A.<\/strong>, condannata dall\u2019Antitrust al pagamento di una\u00a0<strong>multa da trecentomila euro<\/strong>\u00a0per aver aver spedito a migliaia di consumatori degli<strong>\u00a0atti di citazione<\/strong>, cui non ha quasi mai fatto seguito l\u2019effettivo avvio di una causa. I giudici di pace indicati erano poi\u00a0<strong>sistematicamente incompetenti per territorio<\/strong>, visto che nelle cause\u00a0<strong>contro i consumatori l\u2019unico giudice competente per territorio \u00e8 quello di residenza del consumatore<\/strong>.<span id=\"more-3042\"><\/span><br \/>\nLa condotta della societ\u00e0, che operava su incarico di note finanziarie e societ\u00e0 del settore energia, \u00e8 stata ritenuta dall\u2019Antitrust\u00a0<strong>pratica commerciale aggressiva<\/strong>, in quanto finalizzata a indurre forzatamente i consumatori a determinarsi a pagare, anche in presenza di eventuali contestazioni, pur di non vedersi costretti a difendersi in una lontana e dispendiosa causa.
